They are within their rights to verify your income just for this reason;
The real question can you get back your deposit? Not sure depends on the paper work you signed, the fact you can not back up the income stated on the app, and that they probably took the unit of the market
But without the W2’s you will not be approved for the unit

Just tell them the truth, it won’t hurt.

Tell them to kiss off. It really is none of their dam business. The agent needs to be put in their place.
Now the company that your are getting the loan from, they may want to see them as proof of income.
Update – as for your freelance income, if you can’t prove you make it with pay stubs, W2’s or tax returns for the last three years, then in did not happen, and it will not be counted as income.
You are also commenting a crime, it called tax evasion. Hope you get cough.

So, you admit you lied on your rental application. I know if you did this on a mortgage application, it would be a felony. But I don’t think it’s that serious on the rental application.
The problem of course is if your income is 50% of what you told them, they won’t rent to you.
Another problem is the lack of freelance records–how the heck do you do your taxes correctly if you don’t have records? (With records, you have to generally show 3 years of steady income to pass the credit check.)
