How would it be possible for a realty agent to keep your deposit if you haven’t occupied the place yet.?

I was told that he can’t take my deposit he told me he could because his lawyer said so.
Well, the big question is, did you sign anything?
If you did, read it and see what it says about deposits, and that’s what you have to do, no exceptions.
If you didn’t, then, no matter what his lawyer says, no, he CAN’T keep it, although you will probably have to go to Small Claims Court to get it back from him.
If you didn’t sign anything, I would suggest you tell him you’re willing to go to Small Claims if necessary, and then offer to split it with him so you can both just get this over with and move on. It’s a fair deal, and it avoids a lot of hassle for you.
